Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Website Auditor service available at website-auditor.io and its associated API, admin portal, and browser extension (collectively, the "Service"), operated by Armstrong HoldCo LLC ("Website Auditor", "we", "us", or "our"). By creating an account, starting a free trial, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Website Auditor provides website auditing and related tools, delivered through our website, our API, and our browser extension. A paid membership includes: automated fixes for issues identified in your Website Auditor report, the ability to run custom queries across supported AI models, and programmatic access to the Service through our API. Specific features, usage limits, and inclusions are described at the point of sale and may change over time as described in Section 9.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the activity that occurs under your account and for keeping your login credentials and API keys confidential. Notify us promptly of any unauthorized use. You may not share API keys or resell access to the Service without our written permission.

3. Subscriptions and Free Trial

  • Free trial. Eligible new customers may receive a free trial (currently 7 days). You will not be charged during the trial. If you do not cancel before the trial ends, your subscription will automatically begin and the applicable fee will be charged.
  • Billing cycle. Subscriptions are billed in advance on a recurring basis (monthly unless otherwise stated at checkout) to the payment method you provide.
  • Auto-renewal. Your subscription renews automatically at the end of each billing period at the then-current rate until you cancel.
  • Returning customers. Customers who have used a free trial within the last 12 months are not eligible for another trial and will be billed immediately upon subscribing. Customers whose most recent free trial began more than 12 months ago may be eligible for a new free trial.

4. Fees and Payment

The fees for the Service are displayed at checkout. Payments are processed by our third-party payment processor (Stripe); by subscribing you also agree to the processor's terms. You authorize us to charge your payment method for all fees incurred. We may change our fees from time to time; any price change will apply to billing periods after we provide notice as described in Section 9. All fees are exclusive of taxes, which you are responsible for where applicable.

5. Cancellation and Refunds

You may cancel your subscription at any time through the "Manage Subscription" option in the admin portal. Cancellation takes effect at the end of the current billing period, and you retain access until then. Except where required by law, fees already paid are non-refundable and we do not provide refunds or credits for partial billing periods or unused time.

6. Acceptable Use

You agree not to:

  • Use the Service to violate any law or third-party right;
  • Audit, scan, or test any website or system you do not own or are not authorized to assess;
  • Exceed, circumvent, or interfere with usage limits, rate limits, or other technical restrictions;
  • Reverse engineer, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure;
  • Resell, sublicense, or otherwise commercially exploit the Service without our written consent.

We may suspend or terminate access for conduct that violates this section, including current usage limits such as a cap on the number of audits per API key per day.

7. Intellectual Property

The Service, including its software, content, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes during your subscription. You retain ownership of the data and content you submit, and you grant us the rights necessary to operate the Service and generate audit results and reports for you.

8. Third-Party Services and AI Output

The Service integrates third-party providers, including AI model providers. Output generated by AI models and automated fixes are provided for your consideration and may be inaccurate or incomplete; you are responsible for reviewing and testing any output, code, or change before relying on or deploying it. We are not liable for results produced by third-party models or for any action you take based on the Service's output.

9. Changes to the Service or Terms

We may modify the Service or these Terms at any time. If we make material changes, we will provide reasonable notice (for example, by email or through the Service). Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, your remedy is to stop using the Service and cancel your subscription.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that audit results will be accurate or complete.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service or these Terms will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

12. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination (including Sections 4, 7, 10, 11, and 13) will survive.

13. Governing Law

These Terms are governed by the laws of the State of Washington, United States of America, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in the State of Washington for any dispute arising out of or relating to these Terms or the Service.
